Unrepresented Buyer Forms

Sometimes a person who contacts us about a property we have listed is an unrepresented buyer. This means they do not have their own real estate agent or attorney working for them. In these situations it is important to be clear about our role and who we represent. Texas law requires us to give certain forms to ensure everyone understands the relationship from the start. Two key forms you you will receive from us in these situations are the Information About Brokerage Services form and the Notice to Prospective Customer form. These are not optional because they are mandated for compliance, transparency, and legal protection. 1. Information About Brokerage Services (IABS)

Purpose:
The Texas Real Estate Commission (TREC) requires all licensed real estate professionals to provide this document to prospective buyers, tenants, sellers, and landlords. It explains:

  • The different types of real estate license holders such as broker and sales agent

  • The minimum duties a broker owes to a client

  • The ways a broker can represent parties in a transaction such as seller agent, buyer agent, intermediary, or subagent

  • The importance of having clear written agreements outlining representation and payment

Why It Must Be Filled Out:

  • It ensures you understand who we represent in the transaction and what duties we owe

  • It creates a record that you received this legally required information

  • It avoids misunderstandings about roles, duties, and obligations before negotiations begin

Who Signs It:
Anyone we are speaking with about real estate services whether they are a potential client or not must receive this notice. Acknowledging receipt does not obligate you to work with us.

2. Notice to Prospective Customer

Purpose:
If you are not represented by your own real estate agent or attorney, this form clearly states that Kritt Real Estate represents the other party in most cases the seller. It outlines:

  • That we do not represent you as the buyer or tenant

  • That we cannot give you opinions, advice, or assistance beyond the scope of our duties to our client

  • That anything you tell us about the property or your intentions must be shared with our client

  • That you are encouraged to seek your own representation

Why It Must Be Filled Out:

  • It documents that you understand we represent the other party and not you

  • It reduces the risk of misunderstandings or disputes later

  • It protects you by encouraging you to get your own representation for advice and negotiations

Who Signs It:
Any unrepresented person such as buyer, tenant, seller, or landlord who is discussing a property with us that we have listed.
